This English translation is provided for convenience. In the event of any discrepancy, the French version prevails.
1. Purpose
These terms of use (the “Terms”) set out how the lullae.fr and lullae.com websites (the “Site”), published by Lullae, may be accessed and used. Browsing or using the Site implies unreserved acceptance of these Terms. The sale of our products is governed by our terms and conditions of sale.
2. Access to the service
The Site is available free of charge to any user with internet access. Connection and equipment costs are borne by the user. Lullae takes reasonable steps to keep the Site available, without guaranteeing permanent, uninterrupted access: interruptions may occur, in particular for maintenance or upgrades, or in the event of force majeure.
3. Use of the Site
The user undertakes to use the Site fairly and not to:
- interfere with the operation, security or integrity of the Site;
- upload, transmit or distribute unlawful, defamatory, violent or hateful content, or content contrary to public decency or public order;
- upload content that infringes the rights of third parties, in particular intellectual property rights or image rights;
- collect information about other users or attempt to access unauthorised areas.
4. Intellectual property in the Site
All the content of the Site (texts, visuals, illustrations, logos, the Lullae brand, visual identity, code and structure) is protected by intellectual property law and remains the exclusive property of Lullae or its partners. Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written permission is prohibited.
5. Rights in the photographs and content you upload
To create their artwork, the user uploads photographs, images and information (the “Content”). The user retains full ownership of their Content.
By uploading Content, the user represents and warrants that they:
- hold all the rights needed in the uploaded Content (copyright, the photographer’s rights, rights in what is shown);
- have the permission of everyone shown in the photographs, under their image rights, for their use in creating the ordered artwork;
- where the photograph shows a minor, have the permission of their legal guardians;
- where the photograph shows a person who has died, act with the respect due to their memory and, as a relative, have the standing needed to entrust its use to Lullae.
The user grants Lullae a licence strictly limited to producing, manufacturing and delivering the ordered artwork, and to after-sales service. Lullae never reuses the Content for communication, advertising or any other purpose without the user’s express, prior and specific consent. How long Content is kept and how it is deleted is explained in our privacy policy.
The user indemnifies Lullae against any claim, complaint or action by third parties based on the uploaded Content, and bears sole responsibility for it.
6. Liability
Lullae strives to ensure that the information published on the Site is accurate, but cannot guarantee that it is complete or free of errors. Lullae cannot be held liable for any damage resulting from misuse of the Site, temporary unavailability of the service, or the presence of viruses despite the protective measures in place. Links to third-party websites are provided for the user’s convenience, with no commitment as to their content.
7. Personal data and cookies
How personal data is processed is described in our privacy policy, and the use of cookies in our cookie policy.
8. Changes to the Terms
Lullae reserves the right to change these Terms at any time. The applicable version is the one in force when the Site is used.
9. Governing law
These Terms are governed by French law. For any question, the user can email [email protected].
